The Hon'ble Supreme Court of India acknowledged the gravity of sexual harassment of working women at the workplace in Vishaka and Others Vs. State of Rajasthan and Others ("Vishaka Judgment") and established regulations requiring employers to prevent sexual harassment and to provide the procedures for the resolution, settlement, or prosecution of sexual harassment. In accordance with Article 141 of the Indian Constitution, the rules made by the Hon'ble Supreme Court were regarded as laws. It was essential to pass comprehensive legislation that focused on preventing sexual harassment and establishing a redress process because more women were working. The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (hence referred to as the "Act") was finally passed by India in 2013 after 16 years of Vishakha Judgment, for ending the practice of sexual harassment of women at the workplace.
